Update – April 2024: Achkar Law, managed by Mr. Christopher Achkar, filed a SLAPP lawsuit seeking a compensation of $9,000,000 in an act of retaliation against me for different reasons, one of which is the concerns I expressed about the administration of justice by staff of the following courts: - The Small Claims Court in Toronto. - The Divisional Court in Ottawa. I have reasons to believe that Mr. Achkar was acting on instructions he received from the Ministry of the Attorney General. On April 19, 2024, I received an email from one of the counsels, Ms. Madison Chilvers, indicating: “Dear Mr. Madhoun, Attached is our Statement of Claim for the above matter. We trust you have had a copy of our Statement of Claim for over twenty days. If we do not receive your Statement of Defence by Friday, April 26, 2024, we will move to note you in default. We recommend seeking legal representation.” Update- February 2024: ---- I attended a settlement conference with Achkar Law in December 2023. Two days before the conference, they filed confidential health and financial information shared with them in confidence, violating the Rules of Professional Conduct set by the Law Society of Ontario (LSO). I reached out to them, asking for the confidential documents to be withdrawn from the record, and the response I got from the counsel that I used to work with, via email, was: “Hi Mr. Madhoun, We are in the process of seeking advice and will be able to respond to you by the end of this week. We assume this brief indulgence will not be an issue.” Needless to say, Achkar Law didn’t withdraw the documents, nor did they explain whom were they seeking advice from. I ended up filing a complaint with the LSO. Despite providing clear evidence of misconduct by Achkar Law, the response from LSO's counsel was: "You may therefore wish to speak to a lawyer or paralegal about any remedies available to you in the litigation, particularly as it relates to your concerns about the mediation brief filed with the court." I was disappointed with the LSO’s failure to enforce its own Rules of Professional Conduct. ---- I retained the services of this law firm in May for assistance with a legal proceeding in an Ontario court. As this firm offers services to the public, I feel an obligation to share some aspects of my experience: 1. I hired them for an upcoming mandatory mediation with another party, the retainer was signed on May 3, 2023, with mediation scheduled for May 31. 2. The objective was to prepare for mediation and, if necessary, represent me throughout the remaining litigation steps. 3. Despite my time constraints, they delayed working on my case for several days, unnecessarily, despite receiving the retainer funds, on May 3. 4. The initial retainer trust account was depleted, by 90%, in less than three weeks, even though the work done at that point shouldn't have consumed as much time or funds. 5. Their billing scheme included charging for 'receiving emails', a practice I found very unusual. I was billed $38.5/email for merely sending email(s). 6. A few days before the scheduled mediation, I received the first invoice requesting an additional, ~$5000, for trust funds. When I expressed concerns, they made it clear that they would cease work if I didn't pay. 7. To avoid complications with mediation I calculated the billable hours needed to go through the mediation, and provided additional funds. 8. On May 29, 2023, I received another invoice showing the almost-depleted additional funds, with a request for more. They warned that without an additional payment, they wouldn't represent me in the scheduled mediation on May 31, 2023 (two days from their ultimatum). The relationship ended, and I proceeded through mediation as a self-represented litigant. Unfortunately, the mediation failed, and in addition to the substantial fees paid to Achkar Law, I now face setbacks in the original claim. Furthermore, I had no option, to recover the fees I was charged by them, but to commence a claim before one of the courts in Ontario.
